Auto accidents are scary experiences both minor and major. Whether you are a driver, passenger, pedestrian or cyclist, if you were involved in an auto accident you have benefits you can access to aid in the recovery of injuries that you sustained.

Anyone injured in a car accident in Ontario is eligible to make a claim for accident benefits outlined in the Statutory Accident Benefits Schedule (SABS). This includes accident victims who are not covered by their own motor vehicle insurance policy or the policy of a family member, and accident victims who were partially or fully at fault for the accident.

Ontario established this element of its no-fault insurance system to ensure that all accident victims have access to financial resources for timely care.

It is critical to observe certain timelines when applying for accident benefits. Unless your injuries are so severe that you cannot reasonably adhere to these timelines, you have:

  • 7 days to notify your insurer of your intention to apply for accident benefits
  • 30 days to submit your Accident Benefits Application Package

  • Traumatic Brain Injuries (TBIs), including concussions
  • Spinal cord injuries/paralysis
  • Facial and soft tissue injuries
  • Nerve damage
  • Lost limbs
  • Dislocated joints
  • Internal organ damage

Small Claims Court

The Small Claims Court is a branch of the Superior Court of Justice, with a monetary jurisdiction of $50,000.00. This means that an individual and/or corporation can file a claim in Small Claims Court for:

  • breach of contract
  • disputes with contractors
  • unpaid invoices
  • personal injury
  • debt collection
  • damage to property
  • defamation

Criminal Offences (Summary Conviction)

Paralegal may represent accused in summary conviction offences and where Crown elects to proceed summarily with hybrid offences within applicable limits.

The penalty for a summary conviction offence is a $5,000 fine or a jail term of six months or both.

Anyone that has been charged and convicted with a criminal offence should apply for a pardon as it is necessary to travel outside the country, for certain employment opportunities and may prevent you from enrolling in certain programs with colleges and universities.

After 5 or 10 years of completing the sentence, a person who committed a federal offense as an adult (above the age of eighteen) is eligible for a criminal pardon.

Completing the sentence refers to finishing any probationary period, conditional sentence, or incarceration, including time on parole and statutory release, as well as paying any penalties, expenses, surcharges, restitution, and compensation.

Repair Storage and Liens Act (RSLA)

Ontario allows for individuals and corporations to attach liens to property for which they have repaired or stored and an invoice is outstanding (R.S.O. 1990).
